Terms & Conditions of Business
The terms that apply when you book or purchase a service from us.
These Terms & Conditions apply to services supplied by Instructor Hub trading as Driving Success with Dave Leverton, referred to in these terms as “Driving Success”, “we”, “us” or “our”.
Our services include online courses, coaching, professional development, in-car driving instructor training, driving lessons and related training services.
By booking or purchasing a service from us, you agree to these Terms & Conditions.
1. Bookings
Bookings may be made through our website or through other agreed methods of communication.
A booking is not confirmed until it has been accepted by us and any payment or deposit required at the time of booking has been received.
You are responsible for providing accurate contact and booking information.
2. Prices and Payment
Prices will be confirmed before you make a purchase or booking.
Unless otherwise agreed, payment must be made in accordance with the payment arrangements specified when booking.
Where a deposit is required, your booking may not be confirmed until the deposit has been received.
Where training is being paid for in instalments, all payments must be made by the agreed dates.
We reserve the right to suspend access to training or postpone future training sessions where an agreed payment has not been made.
3. Online Courses and Digital Content
Where you purchase an online course or other digital training material, access will be provided in accordance with the information given at the time of purchase.
Course materials are supplied for the personal use of the person who purchased or was registered for the course.
Login details, videos, presentations, downloads and other course materials must not be shared with other people unless we have given permission.
You must not copy, record, reproduce, distribute, sell, publish or commercially exploit our course materials without our prior written permission.
Where an online course is provided for a specified period, the access period will be made clear at the point of purchase or enrolment.
4. Coaching and Online Training Sessions
Coaching, webinars and other live online training sessions will normally take place at the date and time agreed when booking.
You are responsible for ensuring that you have suitable equipment and a sufficiently reliable internet connection to participate.
Where a session cannot proceed because of a technical problem on our part, we will normally rearrange the session or offer another reasonable solution.
5. In-Car Driving Instructor Training
In-car instructor training is designed to support trainee and qualified driving instructors with their knowledge, skills and professional development.
Training may include preparation for DVSA assessments including ADI Part 2 and Part 3.
While we will provide training and guidance to a professional standard, we cannot guarantee that a trainee will pass a DVSA test or assessment.
Success in any assessment will depend on a range of factors, including the trainee's ability, preparation, practice, performance on the day and the requirements of the relevant assessment.
6. Fitness to Drive and Training Vehicles
Anyone participating in practical in-car training must be legally entitled and medically fit to drive the relevant vehicle.
You must tell us about anything that may legally affect your ability to drive or participate safely in a practical training session.
Where a client's own vehicle is used for training, the client is responsible for ensuring that the vehicle is roadworthy, appropriately insured and legally suitable for its intended use.
We may refuse to conduct practical training where we reasonably believe that doing so would be unsafe or unlawful.
7. Driving Lessons
Driving lesson enquiries may be passed to Handley Driving School where appropriate for the purpose of identifying a suitable driving instructor.
Where lessons are subsequently provided by an independent instructor or another driving school, their own lesson terms and conditions may apply.
The identity of the organisation or instructor responsible for providing the lessons should be made clear when the booking is confirmed.
8. Cancellations and Rescheduling
We understand that circumstances sometimes change.
If you need to cancel or rearrange an individually booked coaching or in-car training session, please provide as much notice as possible.
Unless different cancellation terms were clearly stated when booking:
- cancellations made at least 48 hours before the scheduled session may be rearranged without an additional training charge;
- cancellations made with less than 48 hours' notice may be charged at the full session rate; and
- failure to attend an agreed session without notice may be treated as a cancellation and the full session fee may be payable.
We may use reasonable discretion where exceptional circumstances have prevented attendance.
Different cancellation arrangements may apply to courses, events, group training or third-party bookings. Any different terms will be made clear when booking.
9. Cancellation by Driving Success
Occasionally, we may need to cancel or rearrange a training session because of illness, vehicle problems, unsafe weather or road conditions, technical problems or other circumstances outside our reasonable control.
Where this happens, we will aim to give as much notice as reasonably possible and offer an alternative date or, where appropriate, a refund for the affected service.
We will not be responsible for additional expenses reasonably outside our control, such as travel or accommodation costs, unless we have specifically agreed otherwise.
10. Refunds and Consumer Cancellation Rights
Your statutory consumer rights are not affected by these Terms.
Depending on how and when you purchase a service, you may have a statutory right to cancel your contract.
Different rules can apply to services, digital content and training booked for a specific date.
Where you ask us to begin providing a service during a statutory cancellation period, you may be required to pay for services already supplied if the applicable legal requirements have been met.
For digital content, your statutory cancellation rights may be affected where you expressly agree to immediate access and acknowledge that doing so may result in the loss of your cancellation right once supply begins.
Where a statutory right to cancel applies, we will comply with the applicable UK consumer protection legislation.
Nothing in these Terms is intended to remove or restrict your statutory consumer rights.
11. Training Materials and Intellectual Property
Unless otherwise stated, training materials supplied by Driving Success remain our intellectual property or are used by us with permission.
This includes presentations, course notes, worksheets, videos, graphics, training exercises, models, downloads and other educational resources.
Materials supplied to you may be used for your own personal learning and professional development.
They must not be reproduced, uploaded, distributed, sold, used to deliver commercial training to others or otherwise commercially exploited without our prior written permission.
12. Recording Training Sessions
You must not make audio, video or screen recordings of training, coaching, webinars or online course content without our prior permission.
We will seek appropriate permission before intentionally recording a live session involving participants.
13. Behaviour
We aim to provide a professional, respectful and safe learning environment.
We reserve the right to end or refuse training where a participant behaves in a threatening, abusive, discriminatory, dangerous or otherwise seriously inappropriate manner.
Where practical driving is involved, safety will always take priority over completion of the planned training session.
14. DVSA and Other Information
We make reasonable efforts to ensure that our training reflects current DVSA requirements, legislation and accepted industry practice.
However, regulations, DVSA guidance, assessment procedures and industry practices may change.
Where appropriate, trainees should refer to current official DVSA and government guidance.
15. Liability
Nothing in these Terms excludes or limits any liability that cannot legally be excluded or limited.
We will exercise reasonable care and skill when providing our services.
We are not responsible for losses resulting from circumstances outside our reasonable control or for a client's failure to follow training, safety or legal requirements.
Nothing in these Terms affects your statutory rights as a consumer.
16. Personal Information
We collect and use personal information in accordance with our Privacy Policy.
Driving lesson enquiry information may be shared with Handley Driving School for the purpose of helping identify a suitable instructor, as explained in our Privacy Policy.
We do not sell personal information to third parties.
17. Complaints
We want clients to be satisfied with the service they receive.
If you have a concern or complaint, please contact us as soon as possible and provide sufficient information for us to investigate the matter.
We will aim to deal with complaints fairly and within a reasonable period.
18. Changes to Services or These Terms
We may occasionally update these Terms to reflect changes in our services, business practices or legal requirements.
The Terms that apply to your booking will normally be those in effect when your booking or purchase was made, unless a change is required by law or otherwise agreed with you.
19. Governing Law
These Terms & Conditions and any dispute or claim arising from them are governed by the applicable laws of the United Kingdom.
Nothing in these Terms affects any mandatory rights you have as a consumer, including rights relating to where legal proceedings may be brought.
